Social networks are the areas that bring the spammers into the spotlight, whether it is for reasons like seeking publicity or making statements. The tool that is being used to bring the spammers to book are the agreement or the terms that every member has to sign into electronically thus giving their approval.
MySpace has won many trial cases in May and June of 2008 with Scott Richter coughing up a heavy sum of $6 million. Incidentally he had to pay $7 million to Microsoft in 2006 for widespread illicit spamming. Adam Guerbuez has been charged with hijacking of 4 million accounts of Facebook for marketing of drugs and other illegal products.
The MySpace members have to sign an agreement that states that they have to pay $50 for every undesirable email. The social networking companies win lawsuits on the basis of the dollar amount written in these agreements. The CAN-SPAM Act levies a charge of $100 for each contravention with the amount being tripled if found to be a voluntary act.
It seems that both the prosecuting and defensive parties gain lot of publicity with some lawsuits amounting to high compensations.
